Hợp đồng dịch vụ điện tử này (“Hợp Đồng”) được thiết lập giữa:

Phạm vi dịch vụ

hotelworks cung cấp nền tảng tuyển dụng trực tuyến cho phép Khách Hàng:

- Đăng tin tuyển dụng
(Post job advertisements)
- Quảng bá thương hiệu tuyển dụng
(Promote employer branding)
- Tiếp cận ứng viên
(Access candidates)
- Quản lý hoạt động tuyển dụng
(Manage recruitment activities)
- Sử dụng các dịch vụ liên quan theo từng gói dịch vụ được công bố trên website.
(Use related services according to service packages published on the website.)

Hình thức giao kết hợp đồng điện tử

Hợp đồng này được giao kết dưới hình thức điện tử thông qua website hotelworks.com.vn.

Khách Hàng được xem là đã đọc, hiểu và đồng ý toàn bộ nội dung Hợp Đồng khi thực hiện một trong các hành vi sau:
(The Customer shall be deemed to have read, understood, and agreed to the entire contents of this Agreement upon performing any of the following actions:)
- Chọn ô xác nhận đồng ý điều khoản tại trang thanh toán
(Ticking the checkbox agreeing to the terms at the checkout page)
- Nhấn nút “Place Order”, “Đặt hàng”, “Thanh toán” hoặc hành động tương đương
(Clicking the “Place Order”, “Đặt hàng”, “Thanh toán” button or any equivalent action)
- Hoàn tất thanh toán dịch vụ
(Completing service payment)
- Tiếp tục sử dụng dịch vụ trên hệ thống
(Continuing to use the services on the system)
Hợp Đồng điện tử có giá trị pháp lý tương đương hợp đồng giấy theo quy định pháp luật Việt Nam về giao dịch điện tử.
(This electronic Agreement has the same legal validity as a written contract under Vietnamese laws on electronic transactions.)
Giá dịch vụ và thanh toán
(Service Fees and Payment)
Khách Hàng thanh toán phí dịch vụ theo:
(The Customer shall pay service fees according to:)
- Gói dịch vụ
(Service packages)
- Hoặc báo giá
(Or quotations)
được công bố trên website tại thời điểm giao dịch: https://hotelworks.com.vn/shop-2
(published on the website at the time of transaction: https://hotelworks.com.vn/shop-2)
Phương thức thanh toán hiện tại: Chuyển khoản ngân hàng hoặc các phương thức thanh toán khác được website hỗ trợ tại từng thời điểm
(Current payment methods: Bank transfer or other payment methods supported by the website from time to time)
Dịch vụ được kích hoạt sau khi hệ thống xác nhận đơn hàng hoàn tất/thanh toán thành công, kể từ khi itworks nhận được thanh toán.
(The service shall be activated after the system confirms order completion/successful payment, from the date itworks receives payment.)
Quyền và trách nhiệm của itworks

(Provide, modify, or update services on the website)
- Kiểm duyệt nội dung tuyển dụng
(Review recruitment content)
- Từ chối hoặc gỡ bỏ các nội dung vi phạm
(Reject or remove violating content)
- Tạm khóa tài khoản vi phạm quy định
(Temporarily suspend accounts violating regulations)
hotelworks có trách nhiệm:

- Duy trì hoạt động của hệ thống
(Maintaining system operations)
- Hỗ trợ khách hàng trong phạm vi dịch vụ
(Providing customer support within the scope of services)
- Bảo mật thông tin người dùng theo chính sách bảo mật công bố trên website
(Protecting user information in accordance with the privacy policy published on the website)
Quyền và trách nhiệm của Khách Hàng
(Rights and Responsibilities of the Customer)
Khách Hàng cam kết:
(The Customer undertakes to:)
- Cung cấp thông tin chính xác
(Provide accurate information)
- Chịu trách nhiệm về nội dung tuyển dụng đăng tải, đảm bảo nội dung tin đăng tuyển dụng chỉ thuộc phạm vi lĩnh vực nhà hàng, khách sạn, du lịch hoặc các lĩnh vực có liên quan.
(Take responsibility for posted recruitment content and ensure that job postings are limited to the IT field only)
- Không sử dụng dịch vụ vào mục đích vi phạm pháp luật
(Not use the services for unlawful purposes)
- Thanh toán đầy đủ chi phí dịch vụ
(Pay all service fees in full)
Khách Hàng chịu trách nhiệm đối với:
(The Customer is responsible for:)
- Tài khoản đăng nhập
(Login account)
- Nội dung đăng tải
(Posted content)
- Giao dịch phát sinh từ tài khoản của mình
(Transactions arising from their account)
Chính sách đổi trả và hoàn tiền
(Refund and Return Policy)
Do dịch vụ được cung cấp dưới hình thức dịch vụ số và được kích hoạt trực tuyến sau thanh toán, itworks không áp dụng đổi/trả đối với:
(Because the services are provided in digital form and activated online after payment, itworks does not apply returns/exchanges for:)
- Gói dịch vụ đã kích hoạt
(Activated service packages)
- Dịch vụ đã sử dụng
(Used services)
- Tin tuyển dụng đã đăng tải
(Published job postings)
Các trường hợp hoàn tiền (nếu có) được xử lý theo:

Giới hạn trách nhiệm

itworks là nền tảng trung gian kết nối tuyển dụng và không phải là bên tham gia trực tiếp vào:

- Hợp đồng lao động

- Hoặc thỏa thuận giữa Nhà Tuyển Dụng và Ứng Viên

itworks không chịu trách nhiệm đối với:
(itworks shall not be liable for:)
- Nội dung do người dùng đăng tải
(Content posted by users)
- Thỏa thuận riêng giữa các bên
(Private agreements between parties)
- Thiệt hại phát sinh ngoài phạm vi kiểm soát hợp lý của hệ thống
(Damages arising beyond the reasonable control of the system)
- Việc phê duyệt và thời gian hiển thị tin đăng của các đối tác liên kết phân phối tin đăng tuyển dụng
(Approval and display time of job postings by affiliated job distribution partners)
Bảo mật thông tin
(Information Security)
Thông tin người dùng được thu thập, lưu trữ và xử lý theo:

- Chính sách bảo mật

- Quy chế hoạt động
(Operating Regulations)
- Và quy định pháp luật hiện hành
(And applicable laws)
Khách Hàng đồng ý cho phép itworks sử dụng thông tin cần thiết nhằm:
(The Customer agrees to allow itworks to use necessary information for:)
- Vận hành hệ thống
(Operating the system)
- Hỗ trợ giao dịch
(Supporting transactions)
- Chăm sóc khách hàng
(Customer care)
- Và thực hiện nghĩa vụ pháp lý
(And fulfilling legal obligations)
Chấm dứt hoặc tạm ngừng dịch vụ
(Termination or Suspension of Services)
hotelworks có quyền:
(itworks has the right to:)
- Khóa tài khoản
(Lock accounts)
- Hoặc chấm dứt cung cấp dịch vụ
(Or terminate service provision)
đối với các trường hợp:
(in cases involving:)
- Vi phạm pháp luật
(Violations of law)
- Vi phạm quy chế hoạt động
(Violations of operating regulations)
- Hoặc gây ảnh hưởng tới hệ thống và người dùng khác
(Or actions adversely affecting the system and other users)
Điều khoản áp dụng

Khách Hàng đồng ý rằng:

- Quy chế hoạt động
(Operating Regulations)
- Chính sách bảo mật

- Chính sách thanh toán
(Payment Policy)
- Và các quy định được công bố trên website
(And regulations published on the website)
là một phần không tách rời của Hợp Đồng này.

Mọi tranh chấp phát sinh sẽ được ưu tiên giải quyết thông qua thương lượng. Trường hợp không đạt được thỏa thuận, tranh chấp sẽ được giải quyết tại cơ quan có thẩm quyền theo quy định pháp luật Việt Nam.
(Any disputes arising shall first be resolved through negotiation. If no agreement can be reached, disputes shall be settled by competent authorities in accordance with Vietnamese law.)
